Restorative justice processes and related programmes can be implemented at the following points in the criminal justice system:
- Pre-charge, simply with the consent of all the parties and without the engagement of the criminal justice system
- Pre-trial – a matters is diverted away from formal proceedings, subject to the successful participation by an offender and with the consent of the victim. The matter is disposed of without proceedings and the offender does not get a criminal record
- Pre-sentence – in more serious matters, the parties could meet after the offender has been convicted in order to discuss terms that could be set as a condition of a postponed or suspended sentence
- Post-sentence – prior to being released on parole, a meeting can be arranged with all stakeholders.
